ORGANIZER. This competition is run by Propain Bicycles GmbH, Schachenstraße 15, 88267 Vogt.

ELIGIBILITY TO PARTICIPATE. Only natural persons resident in Europe who are at least 16 years old may participate. Employees of Propain Bicycles GmbH, their close relatives (including husbands, wives, mothers, fathers, sisters, brothers, daughters, sons or other people living in the same household) and other persons or third-party companies entrusted with tasks related to this competition are excluded from participation.

PARTICIPATION. To participate in the competition, the following actions must be carried out:

The participant must order one of the following bike models in the period from November 28th, 2024 12:00 CET to December 2nd, 2024 23:59 CET: Spindrift 5 CF, Spindrift 5 AL, Spindrift 5 AL Park, Rage 3 R CF.

If the participant is a registered user of the PROPAIN FRIENDS app and purchases one of the bike models mentioned in the previous paragraph between November 27th, 2024 12:00 CET and November 28th, 2024 12:00 CET using the voucher code communicated via the app, this also counts as participation and the participant additionally receives a double chance of winning.

All participants will be informed of their participation by e-mail on December 03rd, 2024.

Participation in the competition is excluded in countries where such a competition violates applicable law or other regulations. Propain Bicycles GmbH reserves the right to disqualify anyone who violates these conditions of participation from the competition.

DURATION OF THE COMPETITION.

The three winners will be randomly chosen by Propain on December 10 th, 2024 and notified via E-Mail.

Propain Bicycles GmbH accepts no liability for any damage or accidents related to the prize. The winners accept that certain prizes may be cancelled due to influences beyond the control of the organizer.

NO PRIZE TRANSFER OR REFUND. No prize or part of the prize is transferable to other people. The value of the prize cannot be paid out in cash. There are no refunds for prizes. The prize is excluded from any claims for complaint, warranty or exchange

SELECTION AND NOTIFICATION OF THE WINNERS. The winners of the prize will be chosen at random from all participants after the competition has ended. In addition, other people will be drawn at random who will take their place if the prize is not accepted. A potential winner is only a winner if he/she expresses acceptance of the prize within the deadline. The potential winners will be notified via Instagram message.

The prize will only be handed out after the winners have received their bike and the right of withdrawal has expired.

If a potential winner:

(i) cannot be achieved

(ii) does not respond within five (5) business days after the day on which the Organizer contacted him/her,

(iii) does not accept the prize,

(iv) applies the right of withdrawal of the purchase required for participation

the potential winner loses any right to receive the prize.

In this case, the next person will move up, and then another person if necessary. When contacting the potential winners, it must also be checked whether they have fulfilled all the requirements to participate in the competition. If this is the case, these persons will be declared the winners.

LIST OF WINNERS. In the event of a win, the winners agree to the publication of their name on the organizer's online channels. Propain Bicycles GmbH reserves the right to communicate the winners via the PROPAIN website, newsletter, social media channels or other channels.

CHANCES OF WINNING. The chances of winning the competition depend on the number of valid entries. If the participant is a registered user of the PROPAIN FRIENDS app and makes a purchase of one of the bike models mentioned in the “PARTICIPATION” section between November 27th, 2024 12:00 CET and November 28th, 2024 12:00 CET using the voucher code communicated via the app, he/she will receive a double chance of winning.

CONSENT AND WAIVER. The organizer excludes liability for slightly negligent breaches of duty, provided that these do not concern essential contractual obligations, damages resulting from injury to life, body or health, guarantees or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations include in particular the obligation to hand over the item and to transfer ownership of it. Furthermore, we have the obligation to hand over the item free of material and legal defects.

When awarding the prize, the organizer may require the winners to sign a waiver of any liability for damage caused by use of the products.

DISCLAIMER. (i) The Promoter is not responsible for late, incomplete, misdirected, incorrect or lost entries. This includes hardware, software, browser or network or server failures.

(ii) The Organizer reserves the right to disqualify any malicious participant who attempts to circumvent (e.g. bots or hacks) or undermine the participation process.

(iii) The organizer also reserves the right to cancel, postpone or modify the competition if it is unable to continue the competition as planned, e.g. in the event of a virus, bug, hack or other technical or human error.

(iv) In the event of cancellation of the competition, the organiser may conduct a competition with the entries submitted so far and the prizes available.

(v) WARNING: Any attempt by a participant to intentionally disrupt the smooth running of the competition or to prevent its legitimate conduct will, if it occurs, be prosecuted by the organizer under criminal and civil law.

APPLICABLE LAW AND JURISDICTION. This competition is subject to German law. Legal disputes will be dealt with exclusively by courts located in Ravensburg.
